These Terms of Service ("Terms") are a legal agreement between you and Dale Dash, operated by JC Vasquez in Lawrenceville, GA, United States ("Dale Dash," "we," "us," or "our"), governing your use of our route‑planning and delivery application, our website at daledash.app, and any mobile app versions (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.
You are responsible for your account credentials and for all activity under your account. Keep your password secure and notify us promptly of any unauthorized use. You may delete your account at any time from the app's profile screen.
Dale Dash helps drivers and delivery businesses plan and optimize routes, hand off to third‑party navigation apps, record deliveries, and optionally share live tracking with recipients. Routes, distances, and estimated arrival times are estimates only, generated using third‑party mapping data, and are not guarantees. Actual conditions — traffic, road closures, weather, and address accuracy — may differ.
You are solely responsible for operating your vehicle safely and complying with all traffic and other laws. Do not interact with the Service while driving. Plan and review your route before you begin, and use your navigation app responsibly. Dale Dash is a planning tool and is not responsible for how you drive.
You may enter or import addresses, recipient names, and phone numbers to plan deliveries. You represent that you have the right to use this information and to contact recipients (for example, by sending an "On my way" message or a tracking link), and that your use complies with applicable laws, including those governing text messages and privacy. You are responsible for the content you enter and for using customer information only for legitimate delivery purposes.
You agree not to: use the Service for any unlawful purpose; harass, defraud, or send unwanted communications to recipients; upload malicious code; attempt to access other users' data; scrape, reverse‑engineer, or overload the Service; or misuse the mapping, AI, or messaging features. We may suspend or terminate accounts that violate these Terms.
The Service relies on third parties including Google (maps, geocoding, and infrastructure), Stripe (payments), Anthropic (AI features), Brevo (email), and Netlify (hosting). Your use of features that depend on these providers is also subject to their terms. We are not responsible for third‑party services or for the maps, navigation, or results they provide.
The Service, including its software, design, and branding, is owned by Dale Dash and protected by law. We grant you a limited, non‑exclusive, non‑transferable license to use the Service for your own delivery operations. You retain ownership of the delivery data and content you provide, and you grant us the limited rights needed to operate the Service for you.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted, error‑free, or that routes, ETAs, or address matches will be accurate or complete.
To the maximum extent permitted by law, Dale Dash will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, vehicle or property damage, personal injury, or missed or late deliveries, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars (US$50).
You agree to indemnify and hold harmless Dale Dash from any claims, damages, or expenses arising out of your use of the Service, your delivery activities, your content, or your violation of these Terms or of any law or third‑party right.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including payment obligations, disclaimers, limitation of liability, and indemnification) will survive.
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict‑of‑laws rules. You agree that any dispute will be resolved in the state or federal courts located in Georgia, unless applicable law provides otherwise.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by notice in the app. Your continued use of the Service after changes take effect constitutes acceptance.
